The rules and procedures involved in commencing and advancing a claim in the Small Claims Court are less formal than in the Superior Court of Justice but can include stringent deadlines and requirements that can be complicated.

It is important to note that only those claims where the total amount in dispute is $25,000.00 or less (excluding legal costs and interest), may be brought in the Small Claims Court. For claims involving amounts greater than $25,000.00, you must commence your claim in the Superior Court of Justice in order to be fully compensated for all of your losses. The decision to bring a claim in the Small Claims Court or in the Superior Court of Justice involves a thorough consideration of a variety of factors, chief amongst which include the severity of any injuries sustained and the complexity of the litigation. If a claim is commenced in the Small Claims Court then your recovery will be limited to the $25,000.00 monetary limit, and any recoverable amounts in excess of that monetary limit will have to be abandoned.
